The Mediation

The comments at this website apply to Anthony David Parbery. If you are considering a mediator other than Anthony, you need to enquire about the other mediator's process and requirements.

The mediation venue normally requires a room with a clear table and seating to comfortably accommodate everyone who will be present, preferably but not necessarily, a white board and a separate area in which participants can take a break and speak without being overheard. This can be anywhere, provided everyone agrees.

"2. 1) A mediation process is a process in which the participants, with the support of a mediator, identify issues, develop options, consider alternatives and make decisions about future actions and outcomes. The mediator acts as a third party to assist the participants to reach their decision.
2) Mediation processes are not a substitute for individual or organisational legal and/or other expert advice, or individual counselling or therapy. Mediation processes may not be appropriate for all disputants or all types of disputes." (See AUSTRALIAN NATIONAL MEDIATOR STANDARDS - Practice Standards.)

Anthony will not give advice or make a decision for the participants.

Anthony will normally use a model of mediation which involves active face to face participation by the participants with the mediator present and one or more private sessions where each participant speaks to the mediator in the absence of the other participant.

Normally the mediation session is preceded by a pre-mediation preliminary conference.

Participants in the mediation are required to enter into an Agreement to Mediate prepared by the mediator.

The participants may be accompanied, at the mediation session, by their solicitor or may attend alone.

The participants must, when attending the mediation session, have authority to participate and to enter into any agreement reached by them.

Anthony is happy to co-mediate, that is, be one of two mediators present at a mediation.

As mediation is not the only means of attempting to resolve disputes, intending participants need to decide whether this process is appropriate for them and to be aware that mediation does not always provide a resolution of a dispute.
